SOME THOUGHTS ABOUT THE INSURANCE FRAUD AND THE CRIMINAL LAW

Insurance fraud has evolved into a complex form of economic crime that extends far beyond fraudulent insurance claims. It is increasingly connected with money laundering, organised criminal networks, the unlawful disclosure of insurance secrets, and offences related to narcotic drugs. This paper examines these interre-lationships from a criminal law perspective, emphasising the growing importance of financial intelligence, compliance systems, and international cooperation in preventing and detecting such offences. It also highlights the criminological links between drug-related offending and insurance fraud, demonstrating how financial motivations frequently connect these forms of criminality. The study argues that effective criminal justice requires an integrated approach combining criminal law, financial regulation, and risk-based supervisory mechanisms.
