Zaštita životne sredine i ljudska prava

After a long time efforts, environmental protection has reached a level of legal protection at national as well as international level. Formulations and interpretations of this right differ from comprehension that state of the environment has a direct influence to a health, over environmental protection through limited exploitation of natural resources, to formulations of a particular rights on specific qualities of the environment as one of the basic human rights. The highest environmental legal protection standards are based on inventive approach, which results in direct protection of the environment and indirect protection of human rights. This means that an appropriate environmental condition will promote human health and overall good living conditions, e.g. solving environmental problems and establishing highest environmental standards are strong guarantees for the protection of basic human rights. In recent years international and national legal systems are more intensively accepting above mentioned concept of the environmental right protection. European Union and many other developed countries have fully accepted mentioned approach, so this work has an intention to present and recommend the same one to be incorporated into our national legal frames.
